These Terms of Service (“Terms”) govern your access to and use of Tethered, the Tethered website, and related services provided by Tumerit LLC (“Tumerit,” “we,” or “us”). By using Tethered or this website, you agree to these Terms. If you do not agree, do not use the applicable service.

Using Tethered

Subject to these Terms, Tumerit grants you a limited, personal, non-exclusive, non-transferable, revocable license to use Tethered for your own lawful purposes on devices you own or control. Your use of an App Store copy is also governed by Apple’s applicable terms and the standard or custom end user license agreement presented for that app.

Your responsibilities

You are responsible for your devices, Apple account, iCloud account, backups, and the people who can access them. You must use Tethered in compliance with applicable law, Apple’s terms, and any instructions or warnings supplied with your devices. Do not use Tethered to interfere with another person’s device, access data without authorization, bypass security or licensing controls, or use the service for unlawful, harmful, or abusive activity.

Power-management and hardware disclaimer

Tethered provides controls and information relating to power management, charging, sleep, display behavior, and related system functions. You are responsible for reviewing the app’s behavior before relying on it and for maintaining appropriate backups. Tumerit is not a hardware manufacturer and does not provide a hardware warranty. Tumerit is not responsible for data loss, system changes, compatibility issues, unexpected sleep or shutdown behavior, battery-life deterioration, hardware damage, or other consequences resulting from your use of Tethered to the fullest extent permitted by law.

iCloud and third-party services

Tethered may use Apple services, including iCloud, CloudKit, the App Store, and Sign in with Apple. Those services are provided by Apple and are subject to Apple’s terms, policies, availability, and technical limitations. Tumerit does not control third-party services and is not responsible for their acts or omissions. The privacy practices applicable to information handled through Tethered are described in our Privacy Policy.

Purchases and refunds

Purchases made through the Apple App Store are processed by Apple and are subject to Apple’s payment and refund policies. Refund requests should be submitted through the purchase platform. Tumerit does not process App Store refunds directly and does not guarantee that Apple will approve a refund.

Intellectual property

Tethered, its software, design, text, graphics, trademarks, and related materials are owned by Tumerit or its licensors and are protected by intellectual-property laws. These Terms do not transfer ownership to you. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from Tethered except as permitted by law or by a separate written license.

Website and support content

You may use TetheredMac.com for its intended informational and support purposes. Do not submit confidential information, passwords, license tokens, or other sensitive information to a public GitHub issue. GitHub is an independent third-party service and its terms apply to activity there.

Availability, updates, and termination

Features, availability, integrations, and technical references may change without notice. We may update, suspend, or discontinue all or part of Tethered or the website when reasonably necessary, including for maintenance, security, legal compliance, or product changes. You may stop using Tethered at any time. Rights and obligations that by their nature should survive termination will continue, including intellectual-property protections, disclaimers, limitations of liability, and dispute provisions.

Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, TETHERED AND THE WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TUMERIT DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. NOTHING IN THESE TERMS LIMITS A WARRANTY OR RIGHT THAT CANNOT LEGALLY BE EXCLUDED.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TUMERIT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO TETHERED, THE WEBSITE, OR THESE TERMS. TUMERIT’S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TUMERIT FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR USD $100. These limitations apply only to the extent permitted by applicable law.

Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms here and change the effective date. Your continued use of Tethered after an update becomes effective constitutes acceptance of the revised Terms to the extent permitted by law.

Tumerit LLC (“Tumerit,” “we,” or “us”) makes Tethered, an iOS and macOS power-management application. This Privacy Policy explains what information Tethered handles, where it is stored, why it is used, and the choices available to you. It applies to Tethered, this website, and related support interactions.

Information we handle

Tethered is designed to keep application data on your devices or in your private iCloud account. Depending on the features you use, the app may handle:

• Settings and profiles: power, charging, display, notification, shortcut, schedule, and other configuration values.
• User-selected files: custom sounds, notification icons, and an optional avatar image that you choose to use in the app.
• Companion data: telemetry and status values such as battery level, charging and AC state, power mode, display and lid state, CPU and temperature readings, timestamps, computer name, and messages needed to coordinate the iOS and Mac apps.
• Account and entitlement information: an Apple account identifier and, when Apple provides them, an account name or email address; and local entitlement or license material used to verify access to paid features.
• Support information: information you choose to include when you contact us or open a GitHub issue. Please do not post private account credentials, live session tokens, or other sensitive information in a public issue.

How information is collected and used

We receive information when you enter it in Tethered or support communications, when you enable iCloud or companion features, and from Apple services used by the app. We use it to provide and synchronize Tethered features, connect your authorized devices, verify paid-feature access, respond to support requests, protect the service, and comply with law.

iCloud and Apple services

When you enable iCloud features, Tethered uses Apple’s CloudKit private database associated with your Apple account. The app may save the settings, profiles, selected assets, telemetry, status, device name, and companion messages described above. This information is intended for your use across your authorized devices and is not a public database. Apple operates iCloud and processes information under Apple’s terms and privacy policy. Your use of the App Store, Sign in with Apple, and other Apple services is also subject to Apple’s terms and privacy practices.

Telemetry and retention

Telemetry is optional and is used to display device state and enable companion features. Tethered’s companion telemetry records are automatically pruned after 30 days. Current status, settings, profiles, device names, messages, and other synchronization records may remain in your private iCloud account until they are replaced, removed by the app, or deleted through your Apple account or device settings. Local copies remain on your devices until you remove them or uninstall or reset the applicable app, subject to operating-system behavior and backups.

Information we do not sell or use for advertising

We do not sell personal information, share it for cross-context behavioral advertising, or use Tethered application data to build advertising profiles. We do not use third-party advertising SDKs, analytics services, or crash-reporting services in the app. Apple, as the provider of Apple services, may process information under its own policies. If you voluntarily post information to a public GitHub issue, that information is public and is governed by GitHub’s terms and privacy policy.

Security

We use reasonable measures appropriate to the nature of the information, including Apple-provided private iCloud storage and local operating-system protections. No device, network, cloud service, or software can be guaranteed completely secure. You are responsible for securing your Apple account and devices and for choosing carefully what you include in support requests or public issues.

California privacy rights

California residents may have rights under the California Consumer Privacy Act, as amended, depending on whether the law applies to Tumerit and the circumstances of the request. These may include the right to know or access categories and specific pieces of personal information, request deletion, request correction of inaccurate information, limit certain uses of sensitive personal information, and not receive discriminatory treatment for exercising rights. Tumerit does not sell or share personal information for targeted advertising, so there is no sale or sharing opt-out required for that activity.

To make a privacy request, use the Contact link on TetheredMac.com and identify the request as a privacy request. We may need to verify your identity before completing a request. Other U.S. and international rights

Depending on where you live and whether a particular law applies, you may have additional rights to access, correct, delete, restrict, object to, or receive a copy of personal information, or to withdraw consent. You may exercise those rights through the contact method above. You may also have the right to complain to your local data-protection authority. We will apply any mandatory rights and procedures that govern your request.

Children’s privacy

Tethered is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, contact us through the method above so we can review and delete it where required.

Do Not Track and browser privacy signals

TetheredMac.com does not use advertising or cross-site tracking. Because we do not engage in those activities, the website does not currently take a separate action in response to browser Do Not Track signals. We will describe any material change to this practice in a revised policy.

Changes to this policy

We may update this policy to reflect changes in Tethered, our information practices, or applicable law. We will post the revised policy here and update the effective date. Your continued use of Tethered after the revised policy becomes effective means the updated policy applies to your use to the extent permitted by law.
